2 Canadian HR Reporter, a HAB Press business 2019 Arbitrator rules in union's favour against Waypoint PENETANGUISHENE, Ont. — An arbitrator ruled in favour of the Ontario Public Service Employees Union (OPSEU) on the union's allegation of an unfair labour practice against Waypoint Centre for Mental Health Care in Penetanguishene, Ont. In the decision, dated June 12, arbitrator Robert Kitch- en ruled that Waypoint had broken the law by violat- ing section 70 of the Ontario Labour Relations Act, which deals with employer interfer- ence by "the undermining of OPSEU's representation of its members by directly seek- ing feedback of employees on scheduling options," said the union. In November 2018, Way- point management assembled OPSEU-represented workers to present two scheduling op- tions to them and to solicit their feedback — despite knowing the union had categorically rejected one option and had scheduled a members' meeting for a few days later, said OPSEU. "The union has always stated it wants to sit down with manage- ment to find solutions that work for everyone," said Pete Sheehan, president of OPSEU, Local 329. "We continue to come to the ta- ble with an open mind, because the best solutions can, and must, come through collaboration be- tween management and front- line staff. That's the best way to serve our clients. But collabora- tion is a two-way street." Workers at Quebec association agree to deal S AG U E NAY- L AC - S A I N T- JEAN, Que. — United Food and Commercial Workers union (UFCW) Canada, Local 501 members working at the Asso- ciation chasse et pêche Martin- Pêcheur — a hunting and fishing association in Saguenay-Lac- Saint-Jean, Que. — agreed to a new union contract on June 10. Under the new contract, the employees will receive wage in- creases of four per cent in the first year, two per cent in the sec- ond year and 2.5 per cent in the final year, including a $0.25-per- hour increase in the patroller premium, and a $0.25-per-hour increase for assistant reception- ists, said UFCW. Global Mechanical employees ratify contract MISSISSAUGA, Ont. — CLAC, Local 52 members em- ployed by Global Mechanical in Mississauga, Ont., unanimously ratified a new collective agree- ment on June 17. The three-year contract in- cludes a total wage increase of $3.45 per hour and an increase in vacation pay for long-term employees, said the union. "The employees had clear proposals for the new agree- ment," said Joshua Vanderlaan, CLAC representative. "The ne- gotiation committee focused on those proposals, and we were able to reach an agreement that works well for our members." The employees have been represented by the local since 2016, said the union. Wilkinson Construction employees sign agreement TORONTO — CLAC, Lo- cal 52 members employed by Wilkinson Construction, based in Toronto, unanimously rati- fied a new collective agreement on June 18 providing them with wage increases and other im- provements. The three-year contract in- cludes a total wage increase of up to $6 per hour, a $50 annual increase to the boot allowance, the introduction of a foreperson rate, a $0.10-per-hour increase to the pension plan and general updates to the collective agree- ment language, said the union. "We were able to secure good increases for our members," said Joshua Vanderlaan, CLAC rep- resentative.
