PM #40065782 AN ONTARIO arbitrator has reinstated a worker with drug and alcohol addictions who was fired for violating a settlement agree- ment from a previous termina- tion. The worker was employed with Hydro One, an electricity trans- mission and distribution utility serving Ontario, since 2008. The worker's position was a safety- sensitive one and Hydro One had policies requiring employees to attend work without being im- paired. The 52-year-old worker was hired by the City of Calgary to work as a transit operator with Calgary Transit in 2008. He worked as a "big bus" operator, driving standard-sized transit buses. The worker was subject to rules for transit opera- tors that banned distracted driving, including eat- ing and drinking while behind the wheel of a bus. He also received the city's transit operator manual, which stated that any violation of the rules could re- sult in discipline up to and including termination. In 2017, the worker was suspended for five days after a physical altercation with a passenger. This was the only active discipline on his record and was in accordance with the city's progressive discipline process — but steps could be skipped if the miscon- duct was serious.
