SMITH AN ONTARIO hospital's attendance management program set reasonable thresholds to enter employees into the program, but its failure to consider disabilities and accommodation in the process set up the poten- tial for discrimination, an arbitrator has ruled. The Southlake Regional Health Centre in Newmar- ket, Ont., implemented an attendance support pro- gram (ASP) on Apr. 14, 2015. The ASP divided the year into two six-month review periods beginning on April 1 and Oct. 1, respectively.
